Welcome to The Keepsake Capsule. By participating in our workshops or using our custom creation services, you agree to the following terms and conditions. Please read them carefully before engaging with our services. We provide Terms & Conditions as a set of legally binding terms that govern the activities of our website visitors and customers. It is important to note that our Terms & Conditions are not legal advice and should not be considered as recommendations for establishing specific terms between our business and our customers. We highly recommend seeking legal advice to create a personalised Terms & Conditions document that suits the nature of our online store.
1. Workshop Participation
Workshop Enrolment:
Participation in the Wear Your Memories Workshop is subject to availability. All participants must register in advance and provide the necessary details as required.
Materials:
Participants are required to bring their own garment and printed images to the workshop. The Keepsake Capsule is not responsible for providing these materials unless otherwise stated.
Photo Consent:
By participating in the workshop, you consent to having your photograph taken during the session. These photos may be used for promotional purposes, including but not limited to social media, website content, and marketing materials. If you do not wish to have your photo taken, please inform us prior to the workshop.
Liability:
The Keepsake Capsule is not responsible for any damage to garments or images during the workshop process. All care will be taken to ensure a quality experience, but participants engage at their own risk.
2. Custom Creation Service
Order Submission:
Customers must complete the online form with their preferences and send their garments to The Keepsake Capsule for customisation. The Keepsake Capsule is not responsible for any garments lost or damaged during shipping to our location.
Design Process:
The Keepsake Capsule will create a custom graphic print based on the preferences provided. You are entitled to one redesign of your garment's design at no additional charge. Any further redesign requests will incur additional charges, which will be communicated to you before proceeding.
Shipping:
The final product will be shipped back to the customer once the design process is complete. The Keepsake Capsule is not responsible for delays caused by the shipping carrier.
3. Payment and Fees
Workshop Fees:
All workshop fees must be paid in full at the time of registration. Fees are non-refundable unless the workshop is canceled by The Keepsake Capsule.
Custom Creation Fees:
Pricing for custom creations is determined by the complexity of the design and will be communicated to the customer before the process begins. Payment must be made in full before the final product is shipped back to the customer.
Additional Charges:
Any additional charges, such as extra redesigns or expedited shipping, will be agreed upon with the customer before any further action is taken.
4. Cancellations and Refunds
Workshops:
Cancellations made at least 48 hours before the scheduled workshop will receive a full refund. No refunds will be given for cancellations made less than 48 hours before the event.
Custom Creations:
Once the design process has begun, cancellations are not permitted. If you are dissatisfied with the final product, please contact us, and we will work with you to address your concerns.
5. Intellectual Property
Design Ownership:
All designs created through The Keepsake Capsule remain the intellectual property of the customer. The Keepsake Capsule reserves the right to use images of the final product for promotional purposes, unless otherwise agreed upon with the customer.
Copyright:
Customers must ensure that any images provided for use in custom creations do not infringe on any third-party copyrights. The Keepsake Capsule is not responsible for verifying the ownership of images provided by customers.
6. Privacy and Data Protection
Personal Information:
Any personal information provided during the workshop registration or custom creation process will be kept confidential and used solely for the purpose of providing our services.
Photo and Design Use:
By engaging with our services, you consent to The Keepsake Capsule using images of your final product, including any photos taken during the workshop, for promotional purposes.
7. Limitation of Liability
The Keepsake Capsule is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the amount paid by the customer for the specific service in question.
8. Changes to Terms and Conditions
The Keepsake Capsule reserves the right to modify these terms and conditions at any time. Any changes will be communicated to customers and participants, and continued use of our services implies acceptance of the revised terms.
